The arbitrator may permit remote participation by telephone or videoconference where appropriate.

27.4 Applicable Law

  • The laws of the State of Colorado, without regard to conflict of law principles; and

27.5 Authority of Arbitrator

The arbitrator shall have authority to:

  • Award monetary damages permitted by law;

  • Determine the enforceability of this arbitration provision (except where prohibited by applicable law); and
  • Award costs and attorneys’ fees where authorized by law or these Terms.

The arbitrator may not award relief on behalf of persons who are not parties to the arbitration.

  1. Class Action Waiver

To the fullest extent permitted by applicable law:

You and Baker Tubulars each agree that any claim shall be brought solely in an individual capacity.

Neither party shall participate as:

  • A class representative;
  • A class member;
  • A private attorney general;
  • A representative plaintiff; or
  • A participant in any class, collective, consolidated, coordinated, or representative action.

The arbitrator shall have no authority to consolidate claims of multiple individuals unless all parties expressly consent in writing.

If this Class Action Waiver is determined unenforceable with respect to a particular claim, only that claim shall proceed in court, while all remaining claims shall remain subject to arbitration to the fullest extent permitted by law.

  1. Small Claims Exception

Notwithstanding the arbitration provisions above, either party may pursue an individual claim in a court of competent small claims jurisdiction if:

  • The claim qualifies for small claims court under applicable law; and
  • The matter remains solely an individual action.

If the matter is transferred, appealed, or otherwise removed from small claims court, it shall thereafter be subject to the arbitration provisions contained in these Terms unless prohibited by applicable law.

  1. Injunctive Relief

Nothing in these Terms prevents either party from seeking temporary, preliminary, or permanent injunctive or equitable relief from a court of competent jurisdiction when reasonably necessary to:

  • Protect intellectual property rights;
  • Protect confidential information;
  • Prevent unauthorized access to computer systems;
  • Prevent misuse of trademarks or copyrighted materials;
  • Prevent irreparable harm that cannot adequately be remedied through monetary damages.

Seeking such relief shall not constitute a waiver of the obligation to arbitrate any remaining claims.

  1. Attorneys’ Fees and Costs
